Supreme Court rejects Asian carp appeal

The US Supreme Court has rejected an appeal by five states who seek stronger measures for keeping Asian carp out of the Great Lakes.?

The U.S. Supreme Court on Monday rejected an appeal by five states seeking an order requiring that a range of steps be taken to keep the invading Asian carp out of the Great Lakes where they are considered a threat to fisheries.

The high court refused to hear an appeal by Michigan, Minnesota, Ohio, Pennsylvaniaand Wisconsin after the states lost their bid for a preliminary injunction that would have required additional efforts to stop the migration of the voracious carp into the lakes.

The carp have taken over stretches of the Mississippi River and its tributaries. The U.S.Army Corps of Engineers and the Chicago area waterway system already have adopted a number of measures to block the advance of the carp into Lake Michigan.

The states have argued that two species, the Bighead and Silver carp, pose a severe threat to the Great Lakes' $7 billion fisheries. The carp can spread rapidly, crowding out other native fish species.

A federal judge and a U.S. appeals court in Chicago denied the request for a preliminary injunction that would have required additional physical barriers in the Chicago area waterways, new procedures to stop the carp and the speeding up of a study on how to devise a permanent solution to the problem.

In their appeal, the states said the Supreme Court "should grant review and reverse to abate an imminent threat to one of the most precious freshwater ecosystems in the world."

The federal government opposed the appeal, said the case does not warrant further review and told the Supreme Court that the effort to prevent the spread of the carp was already being effectively managed by federal, state and local agencies.

U.S. Solicitor General Donald Verrilli said the states failed to show the need for preliminary injunctive relief and that the litigation should be allowed to proceed before a federal judge in Chicago.

In 2010, the Supreme Court on three separate occasions rejected an appeal byMichigan, refusing to get involved in the legal battle over the carp.

Every year, we at Rotten Tomatoes sit in a room and try to pick who's going to win what at the Academy Awards. And every year, when Monday rolls around, we're frustrated, stunned, hurt -- we run the whole gamut of emotions, but one thing is clear: we didn't have any idea who would win. So why do we continue to apply scientific theories to our predictions, knowing that the whole process is a futile as guessing who will win the NFC East next year? Because we must. Without further ado, we present the RT editors' picks for the 84th Academy Awards. Take this list with a grain -- nay, a shaker -- of salt.


Best Motion Picture of the Year: The Artist


There's been a certain inevitability about The Artist; it's taken top honors at the Golden Globe, the BAFTAs, and the Directors Guild of America Awards. It's a celebration of the movies (which the Academy can certainly appreciate) that's likeable but not lightweight. In other words, it has just enough gravitas that voters can feel comfortable choosing it over Hugo (another delightful homage to old movies that might lose simply because Martin Scorsese got his long overdue Best Picture/Director statues in 2007) and The Descendants (which just doesn't feel like it has the momentum). We think The Artist is going to win big Sunday night, and we haven't seen many signs that would dissuade us from what's become a majority opinion.

Best Achievement in Directing: Michel Hazanavicius, The Artist


It's rare that the director of the Best Picture winner doesn't take this one as well. Plus, if you win the Directors Guild of America award, you're practically a mortal lock for the Oscar. Even though Hazanavicius is up against some big names, we think he's got this one.

Best Performance by an Actor in Leading Role: George Clooney, The Descendants


The Academy loves George Clooney. The Academy also loves it when people deglamorize themselves. Thus, we're giving the Descendants star the nod over Jean Dujardin in what amounts to a two man race.

Best Performance by an Actress in a Leading Role: Viola Davis, The Help


Just about everyone commended The Help's ensemble acting, but even then, Viola Davis was singled out for praise. She was nominated once before (for Doubt, in 2008), and we think she's taking home the hardware this time.

Best Performance by an Actor in a Supporting Role: Christopher Plummer, Beginners


This category is tough, because it features two elderly legends who've never won an Oscar: Christopher Plummer and Max Von Sydow. The Academy has snubbed these guys many times before (Von Sydow deserved to win for The Seventh Seal, Plummer for Star Trek VI: The Undiscovered Country). Since Plummer already won the BAFTA, the Golden Globe, and like, every critic organization's award, we think he'll get the nod here.

Best Performance by an Actress in a Supporting Role: Octavia Spencer, The Help


We think this one's pretty much a gimmie -- Spencer won the BAFTA, the Golden Globe, and the Screen Actors Guild awards in this category. And like Davis, she stood out in The Help, which is no small praise considering the actresses in that movie.

Best Animated Feature Film: Rango


With no Pixar flicks in the running this year, this category is wide open. We think Rango will take it, because it's fun and funny, and because it's loaded with movie references. (We could see the widely-praised but little-seen Chico & Rita sneaking in here, but we're sticking with the lizard.)

Best Original Screenplay: Woody Allen, Midnight in Paris


It won both the Golden Globe and the Writers Guild of America award in this category, so that's a good sign. Plus, it's another opportunity to give some love to the Woodman's prodigious, prestigious output -- even if Allen's recent films have varied in quality, he's still capable of making really good movies at an advanced age, which is something that the Academy members certainly admire.

Best Adapted Screenplay: Alexander Payne, Nat Faxon, and Jim Rash, The Descendants


Alexander Payne is a screenplay adaptin' maniac. He already won an Oscar for Sideways, and it seems safe to say he'll get his second one here.

Remember when Lord of the Rings: Return of the King swept the Oscars partly because it was awesome but partly because the Academy wanted to give props to the whole series? This is the documentary version of that scenario. It also doesn't hurt that the Paradise Lost movies help spring three innocent people from the joint.

Best Foreign Language Film: A Separation


This one seems like a lock, since audiences and critics love it, and because it was also nominated for Best Original Screenplay. It also provides the Academy with a chance to spread some international goodwill at a time when the world community is rattling its sabers at Iran.

(AP) ? Reveling in his sporting element, President Barack Obama waded into the oversize embrace of some of the biggest names in professional basketball Thursday, raising money from current and former NBA greats and an intimate group of supporters drawn to this weekend's All-Star game in nearby Orlando.

Obama indulged his NBA habit at the home of Dallas Mavericks guard Vince Carter where about 70 guests gathered for a $30,000-a-person fundraiser. Among those invited were former L.A. Lakers star Earvin "Magic" Johnson, former Miami Heat star Alonzo Mourning and Chris Paul of the Los Angeles Clippers.

Mark Cuban, the Mavericks' owner, and Obama embraced warmly as the president entered.

The group gathered in Carter's gymnasium, with the scoreboard showing 2012 on the clock and the score tied at 44, Obama being the 44th president.

"It's a nice gym," Obama observed, understatedly. "Vince said he left the other side open in case I wanted to get in a dunk contest with him. I told him I didn't bring my sneakers, so not tonight."

Obama thanked NBA Commissioner David Stern, also in attendance, for resolving the basketball lockout that delayed the start of the basketball season.

"I don't know what I would be doing with myself if I at least didn't have some basketball games around," Obama said.

The fundraiser capped a day hauling in campaign cash, taunting Republicans and pushing his energy policy in the face of rising gasoline prices.

Obama, appearing in a state he carried in 2008 and one he may need to win again to hold the White House, cast Republicans as protectors of the wealthy, telling supporters at a fundraiser that the GOP hopefuls seeking his job would leave everyone else to fend for themselves. His comments came after he had assailed Republicans earlier in the day for offering what he described as flawed and dishonest plans to lower gasoline prices.

"I'm here to tell them they are wrong about America," Obama said. "Because in America we understand ? yes, we're rugged individuals. Yes, we don't expect a handout. But we also understand we are greater together than we are on our own."

The president headlined three campaign fundraisers in Florida, a traditional political battleground that could be key to his re-election hopes. But he had more than the November election on his mind.

An avid basketball fan, the president also lamented missing Thursday night's highly anticipated NBA matchup in South Florida between the Miami Heat and the New York Knicks ? including the Knicks' emerging superstar, Jeremy Lin.

"I'm resentful I'm not going to the game tonight. I'm mad about that," Obama joked. "It's not right. It's not fair."

Obama did manage to watch the first half of the game on television aboard Air Force One. The plane ? a smaller 757 instead of his usual 747 ? landed in Orlando as the first half ended with the Heat up 51-47.

The Knicks have catapulted to national attention by stringing together a series of wins on the shoulders of Lin, a previously unknown Chinese American Harvard University grad who has captured imaginations among fan and non-fan alike and given rise to a new emotion, "Linsanity." The craze has reached the White House, with presidential spokesman Jay Carney confessing last week that Lin was the subject of presidential talk aboard Marine One, the president's helicopter.

Obama also raised money at the Coral Gables home of developer Chris Korge, a top fundraiser for Hillary Rodham Clinton's 2008 presidential campaign. About 100 supporters paid at least $15,000 to attend the event inside Korge's walled compound.

"We've got a good story to tell about the last three years, but I'm not done here," the president said. "I need five more years."

Last week, Obama took a three-day West Coast trip and raised about $8 million in eight campaign events.

Before his fundraising blitz, Obama spoke to a campaign-like crowd at the University of Miami to defend his energy policy in the midst of spiking gasoline prices.

He predicted his Republican rivals would offer nothing but more drilling and political promises of $2-a-gallon gas.

"That's not a plan, especially since we're already drilling," he said. "That's a bumper sticker."

His trip to Florida came as gasoline has reached the highest price at the pump ever for this time of year: an average of $3.58 per gallon. White House advisers see it as a cyclical occurrence but knew Obama had to address the topic, one of deep concern to consumers and growing fodder for Republicans seeking to unseat Obama.

Obama said gasoline prices were "like a tax straight out of their paychecks." He promoted an energy agenda of oil, gas, wind, solar, nuclear and biofuel energy.

And he took aim at Republicans.

"You can bet that since it's an election year, they're already dusting off their three-point plans for $2 gas. I'll save you the suspense: Step one is to drill, step two is to drill, and step three is to keep drilling. ... We've heard the same thing for 30 years. Well, the American people aren't stupid."

Obama insisted there are no short-term solutions to high gas prices, and that anyone suggesting otherwise was not being honest. Still, he sought to offer something to anxious voters by saying he had ordered his administration to search for every possible area to help consumers in the coming months.

He sought to take credit for rising oil and natural gas production, a greater mix of energy sources and decreased consumption. He promoted an energy strategy that the administration says will reduce dependence on foreign oil in the long term.

Republicans have seized on the issue, citing Obama's decision to reject a permit for a cross-country oil pipeline as evidence of a misguided policy. Former Pennsylvania Sen. Rick Santorum has warned of $5-a-gallon gasoline, while former House Speaker Newt Gingrich has said he could lower prices to $2.50 a gallon.

Obama aides worry that the rise in prices could reverse the country's economic gains and the president's improved political standing. A new Associated Press-GfK poll shows that though Obama's approval rating on the economy has climbed, 58 percent disapprove of what he's doing on gas prices.

So What Could Nanopore Mean for Bacterial Genomics? (And the ...

By now, you might have heard about Oxford Nanopore?s first preview of their Gridion and Minion technologies at the recent AGBT conference. While I think some caution is in order, I don?t think this will turn out to be ?vaportech.? While much of the discussion has understandably focused on what Nanopore means for human genomics, I want to discuss what this technology could?note the world could?mean for bacterial genomics, since humans are boring (for ease of writing, I?m going to lump Gridion and Minion together and call them ?Nanopore?).

I see the promise of bacterial genomics built around the sequencing of hundreds of genomes per week. Not that there?s anything wrong with sequencing a small number of genomes, but being able to do high-throughput genomic epidemiology is going to be a key area (and with 3,700 hospitals in the U.S. alone, a potentially very lucrative one). To do this, your processes will have automated, which means you will need very high quality data. In addition, we won?t be using reference genomes, but generating de novo assemblies. To translate this into English (or my approximation thereof), we are looking for new genes (e.g., antibiotic resistance genes) and genetic structures (e.g., plasmids), not asking how a given bacterium differs from a known ?reference? sequence (which has the limitation of not being able to examine differences that aren?t found in your reference sequence?you can?t compare something to something you don?t know about?).

Before we get to Nanopore, let?s quickly review sequencing. We don?t actually sequence a genome in one fell swoop: we chop the DNA into pieces, from one hundred to five hundred base pairs long (?bp?, where one bp is a single ?letter? or nucleotide of DNA) and sequence those fragments. For reference, even a stripped down E. coli like E. coli K-12, the archetype microbial lab rat, has 4.6 million bp of DNA. We also then sequence another DNA preparation from the same bacterium (a ?DNA library?) with larger fragments, usually around 5,000 bp (5 kb), and sequence each end of that fragment?this is called a ?jumping library? or ?jumps? (I?m leaving out a lot of molecular biology to make this happen).

The small fragments can be piled or ?tiled? on each other to create a stretch of sequence known as a contig. Like so:

Becomes: AGCTCA (although we typically have much more ?coverage??many more reads confirming each base). This works fine until you have repetitive content?identical (or nearly so) sequences that occur throughout the genome. Suppose our genome has unique sequences A, B, and C, with a repetitive region X between them. It?s impossible to figure out from tiling reads if we have A-X-B-X-C or A-X-C-X-B. We solve this by using the bits of sequence at the end of the much larger pieces to stitch the individual contigs into a scaffold. Remember, with most current sequencing technologies we can?t simply sequence the entire large piece of DNA.

That?s where Nanopore is very exciting.

Nanopore claims that they?ve been able to sequence huge pieces of DNA (much larger than 5kb). Not only does this mean we can avoid making two DNA libraries?and in bacterial genomics, the true cost of DNA preparation is currently about 8-9 times that of sequencing the prepared DNA*?but the ?jumping library? with the large fragments is the more expensive and time consuming library. It also means that we?ll have fewer stretches of unknown sequence in bacterial genomes (the ?Xs? from the previous example). And, without getting into technical details, it?s much easier to assemble fragments than fragments and jumps.

So this could be a ?game changer.? If.

I have two concerns. The minor concern is that Nanopore will be more likely to sequence the smaller pieces of DNA than the larger ones. When we chop DNA into pieces, let?s say 5 kb, we actually get a spread of sizes. We can make that spread quite small, but doing so is not fast and requires a lot of labor. That is, money. But that?s a minor concern, since there are probably clever tricks one could do to get around this.

The major concern is the error rate. More specifically, it?s the kind of error. According to Nanopore, the ?indel? error rate is about four percent. That is, every four out of one hundred bases, a base is either erroneously added or deleted due to sequencing error. When I?ve seen data of the same strain?a clinical isolate of E. coli?sequenced with different technologies, the overall assembly statistics often look good: we?re able to assemble it into a few pieces (remember, fewer pieces is better). If there?s a known reference, most of the reference is successfully sequenced too.

But the problem comes when we try to annotate the genome?that is, figure out what the genes are contained in the sequence. In my experience, technologies that have a lot of ?indels? in the raw sequence end up with lots of ?broken genes? because enough of those indels wind up in the final, assembled genome (for the cognoscenti, a 1-in-10,000 final indel rate will bust up lots of genes). To explain this, consider this ?toy? gene (genes are much longer, but bear with me):

This encodes a protein that?s three amino acids long (an amino acid is the smallest subunit of a protein and is represented by three nucleotides known as a codon). The ?TGA? is a ?stop codon? and represents the end of the protein. Now, imagine we have an indel in our sequence (the boldface is the insertion):

ATG CCC CAT ATG A

OH NOES! Not only have we changed the amino acid in the third position (ATA ?> CAT), but we removed the stop codon so the software that identifies genes (a ?gene caller?) just keeps on going, like the runaway subway car in Pelham 123 (ALL THE LIGHTS ARE GREEN!! AAAIIEEE!!!). We now incorrectly think the protein is much longer. Not only did we screw up this gene, but we might have also read into the next gene (ALL THE LIGHTS ARE GREEN!! AAAIIEEE!!!), thereby screwing that one up too. Like I mentioned, in my experience, indel prone technologies yield many more indels in the final genome sequence. Many more.

Now, a human can catch this and note it, but humans are error-prone and slow. Slow means expensive and puts the kabosh on the whole hundreds per week idea. Unless the error is confirmed though, we have to treat it as ?real? for any kind of analysis (otherwise we?re cheating). We can manually confirm these errors, but that?s even slower and more expensive.

What profit a Mad Biologist who gains cheap sequence only to have to pay tons of money on the back end? (I think that?s in the Bible somewhere).

Now, Oxford Nanopore claims that, by the time the sequencers ship, they?ll have fixed this. If they do, this technology is a breakthrough. If not, it still has utility, in that we can use it to stitch contigs together, but then it?s a companion technology, not the droids breakthrough we?ve been looking for. When research groups put Nanopore through its paces, then we?ll see if it lives up to the promise (or hype, if you prefer).

Hopefully, it will.

*Since I don?t work on human genomes which are about ~1000 times larger than bacterial ones, the actual sequencing costs are trivial. Library construction costs are the same, however, regardless of the size of the genome. I occasional joke that I?m not in the sequencing business but the library construction business, since that?s the expensive part.

Legal Theory Blog: Legal Theory Lexicon: Originalism

Introduction

There are many different theories of constitutional interpretation, but the most controversial and also perhaps the most influential is "originalism"--actually a family of constitutional theories. The idea that courts would look to evidence from the constitutional convention, the ratification debates,The Federalist Papers, and the historical practice shortly after ratification of the Constitution of 1789 (or to equivalent sources for amendments) is an old one. This post provides a very brief introduction to "originalism" that is aimed at law students (especially first-year law students) with an interest in legal theory.

Originalism is not just an ivory tower theory. It has had a profound influence on the practice of constitutional interpretation and the political contest over the shape of the federal judiciary. President Reagan's nomination of Robert Bork (an avowed originalist) was one key moment--with his defeat by the Democrats was seen as a political rejection of originalism. The current Supreme Court has at least two members who seem strongly influenced by originalist constitutional theory--Associate Justices Antonin Scalia and Clarence Thomas and two others, John Roberts and Samuel Alito who may also be receptive to originalist arguments.

The Origins of Originalism

No one scholar or judge deserves credit for originalism as a movement in constitutional theory and practice, but in my opinion one of the crucial events in the originalist revival was the publication of Raoul Berger's book,?Government by Judiciary?in 1977 by Harvard University Press. As you can guess from the title, Berger's book was?very?critical of the Warren court (and its aftermath in the 70s). One of the key responses to Berger was the publication of?The Misconceived Quest for the Original Understanding?by Paul Brest in 1980. Brest's article initiated an intense theoretical debate over the merits of originalism that continues today. The landscape changed again in the late 1980s, when Justice Antonin Scalia suggested that originalists should shift their attention from "the original intentions of the framers" to the "original public meaning of the constitutional text."

The New Originalism

The final chapter of the originalism debate in legal theory has yet to be written--and perhaps it never will be. But one last set of developments is particularly important. In the 70s and early 80s, originalism was strongly associated with conservative judicial politics and conservative legal scholars. But in the late 1980s and in the 1990s, this began to change. One of the important moves was the shift from "original intentions" to "original public meaning," but two other developments were key. First, Bruce Ackerman's work on constitutional history suggested the availability of "left originalism" that maintained the commitment to the constitutional will of "We the People" but argued that the constitution included a New Deal constitutional moment that legitimated the legacy of the Warren Court. (Ackerman does not call himself an "originalist," but many of Ackerman's former students do work that is implicitly or explicitly originalist.)? Second, Randy Barnett (the leading figure in libertarian legal theory) embraced originalism in an influential article entitled?An Originalism for Nonoriginalists.? The most recent development in this dynamic is Jack Balkin's attempt to reconcile originalism with living constitutionalism. ?Balkin's article, "Abortion and Original Meaning" (link provided below) elicited a good deal of commentary and criticism.

After the publication of Paul Brest's?Misconceived Quest?one heard talk that originalism was dead as a serious intellectual movement. These days one is just as likely to hear pronouncements of a different sort: "we are all originalists" or "originalism and living constitutionalism are compatible" or even "originalism is trivially true.? Contemporary debates about originalism sometimes use the label, "the New Originalism" to distinguish the current emphasis on "original public meaning" from older forms of originalism that emphasized "original intentions."? The story of that transition is crucial to understanding the current discussion among constitutional theorists.

Original Intentions

Early originalists emphasized something called?the original intentions of the framers. Even in the early days, there were disputes about what this phrase meant. Of course, there were debates about whether the framers (a collective body) had any intentions at all. And there were questions about what counted as "intentions," e.g. expectations, plans, hopes, fears, and so forth. But the most important early debate concerned levels of generality. The intentions of the framers of a given constitutional provision can be formulated as abstract and general principles?or?as particular expectations with respect to various anticipated applications of the provision. Most theorists will assent to this point, which flows naturally from the ordinary usage and conceptual grammar of the concept of intention. The difficulty comes because the different formulations of intention can lead to different results in any given particular case. For example, the intention behind the equal protection clause might be formulated at a relatively high level of generality--leading to the conclusion that segregation is unconstitutional--or at a very particular level--in which case the fact that the Reconstruction Congress segregated the District of Columbia schools might be thought to support the "separate but equal" principle of?Plessy v. Ferguson. Perhaps the most rigorous defender of the original intentions version of originalism has been Richard Kay in a series of very careful articles.

Yet another challenge to original-intent originalism was posed by Jefferson Powell's famous article,The Original Understanding of Original Intent, published in 1985. Powell argued that the framers themselves did not embrace an original intention theory of constitutional interpretation. Of course, this does not settle the theoretical question. The framers, after all, could have been wrong on this point. But Powell's critique was very powerful for those who insisted that constitutional interpretation must always return to origins. A certain kind of original-intent theory was self-defeating, if Powell's historical analysis was correct. Moreover, some of the reasons that Powell identified for the framers' resistance to originalism were quite powerful. Especially important was the idea that "secret intentions" or "hidden agendas" had no legitimate role to play in constitutional meaning. In the end, however, Powell's article actually had the effect of turning originalism in a new direction--from original intention to?original meaning.

Original Public Meaning

The original-meaning version of originalism emphasizes the meaning that the Constitution (or its amendments) would have had to the relevant audience at the time of its adoptions. How would the Constitution of 1789 have been understood by an ordinary adult citizen at the time it was adopted? Of course, the same sources that are relevant to original intent are relevant to original meaning. So, for example, the debates at the Constitutional Convention in Philadelphia may shed light on the question how the Constitution produced by the Convention would have been understood by those who did not participate in the secret deliberations of the drafters. But for original-meaning originalists, other sources become of paramount importance. The ratification debates andFederalist Papers?can be supplemented by evidence of ordinary usage and by the constructions placed on the Constitution by the political branches and the states in the early years after its adoption. The turn to original meaning made originalism a stronger theory and vitiated many of the powerful objections that had been made against original-intentions originalism.

This sets the stage for what is sometimes called ?the New Originalism???and also is called ?Original Meaning Originalism.?? ?Whatever the actual origins of this theory, the conventional story identifies Antonin Scalia as having a key role.??As early as 1986, Scalia gave a speech exhorting originalists to ?change the label from the Doctrine of Original Intent to the Doctrine of Original Meaning.?? ?The phrase ?original public meaning? seems to have entered into the contemporary theoretical debates in the work of Gary Lawson??with Steven Calabresi as another ?early adopter.?? ?The core idea of the revised theory is that the original meaning of the constitution is the original public meaning of the constitutional text.

Randy Barnett??and Keith Whittington??have played prominent roles in the development of the ?New Originalism.???Both Barnett and Whittington build their theories on a foundation of ?original public meaning,? but they extend the moves made by Scalia and Lawson in a variety of interesting ways.?For the purposes of this very brief survey, perhaps their most important move is to embrace the distinction between ?constitutional interpretation? understood as the enterprise of discerning the semantic content of the constitution and ?constitutional construction,? which we might tentatively define as the activity of further specifying constitutional rules when the original public meaning of the text is vague (or underdeterminate for some other reason).??This distinction explicitly acknowledges what we might call ?the fact of constitutional underdeterminacy.?? ?With this turn, original-meaning originalist explicitly embrace the idea that the original public meaning of the text ?runs out? and hence that constitutional interpretation must be supplemented by constitutional construction, the results of which must be guided by something other than the semantic content of the constitutional text.

Once originalists had acknowledged that vague constitutional provisions required construction, the door was opened for a reconciliation between originalism and living constitutionalism.??The key figure in that reconciliation has been Jack Balkin, whose influential 2006 and 2007 essays?Abortion and Original Meaning?and?Original Meaning and Constitutional Redemption?have argued for a reconciliation of original meaning originalism with living constitutionalism in the form of a theory that might be called ?the method of text and principle.?? Balkin has called his position on the relationship between originalism and living constitutionalism "comptibilism," but it is important to understand that this means that an originalist approach to?interpretation?is consistent with a living constitutionalist approach to?construction.

Regime Theory

Yet another important twist in originalist theory is emphasized by the work of Bruce Ackerman: a twist that I shall call "regime theory." The foundation for regime theory is the simple observation that the Constitution of the United States was adopted in several pieces--the Constitution of 1789 was supplemented by a variety of amendments. And of these amendments, the three reconstruction amendments (the 13th, 14th, and 15th) are of especial importance--because of the significant structural transformation they work in the relationship between the powers of the national government and the powers of the states. Interpreting the whole Constitution requires an understanding of the relationship between the provisions of 1789 and those adopted during Reconstruction. Some regime theorists argue that the interaction between these two constitutional regimes has the implication that provisions adopted in 1789 take on a new meaning and significance after the Reconstruction Amendments were adopted.

Ackerman's own version of regime theory includes a fascinating and important challenge for originalists of all stripes. Ackerman emphasized the fact that both the Constitution of 1789 and the Reconstruction Amendments were adopted through processes that were extralegal under the legal standards the prevailed at the time. The Articles of Confederation required unanimous consent of all the states for constitutional amendments and for complicated reasons, it seems likely that the Reconstruction Amendments were of dubious legality if strictly judged by the requirements set forth for amendments in Article V. Ackerman's conclusion was that the Constitution derives its legitimacy, not from the legal formalities, but from "We the People," when mobilized in extraordinary periods of constitutional politics. Perhaps the most controversial conclusion that Ackerman reaches is that the New Deal involved another such constitutional moment, in which "We the People" authorized President Roosevelt to act as an extraordinary Tribune, empowered to alter the constitutional framework through a series of transformative appointments. If one accepts this view, then one might begin to ask questions about the "original meaning" of the New Deal--a kind of originalism that would surely not be embraced by the conservative proponents of originalism in the 70s and early 80s.

Does Originalism Have a Core???

Originalism continues to evolve, and the lines of development sometimes converge, but it is fair to observe that originalism in the early years of the twenty-first century has several variations.? "Original public meaning" is one focal point, and the distinction between "interpretation" and "construction" has gained widespread traction, but there are many points upon which originalists disagree.? This leads to the question: does originalism have a core?? One answer to this question focuses on the distinction between two dimensions of the debate about originalism.? The first dimension is?semantic: the semantic dimension of controversies about constitutional interpretation addresses the question, "What is the?meaning?of the constitutional text?"? The second dimensions isnormative: the normative dimension of debates about constitutional practice addresses the question: "How should constitutional actors (judges, other officials, and citizens) act once the meaning of the constitution has been determined?"? If there is any core to contemporary originalism, it focuses on the?semantic?dimension.? Almost all originalists agree that the semantic content of a given constitutional provision was fixed during the period of drafting and ratification.? Some originalists believe that original intentions fixed the meaning; most contemporary originalists believe that "original public meaning" or "conventional semantic meaning" fixed the content.? Some originalists belive that originalism is normatively justified by popular sovereignty theory: we should adhere to the original meaning because it was ratified by "We the People."? Other originalists, like Randy Barnett, argue that the legitimacy of the Constitution is a function of the justice of its content.? And yet other originalists have argued that adherence to original meaning is justified by the rule of law values of predictability, certainty, and stability.? These disagreements about normative foundations may lead to further disagreements about the extent to which "original meaning" should trump other considerations.? For example, should constitutional actors?alwaysadhere to original meaning when it conflicts with historical practice or judicial precedent?

Originalism and Precedent

We are already beginning to see originalists coming to grips with the relationship between original meaning and?precedent--both in the narrow sense of Supreme Court decisions and the broader sense of the settled practices of the political branches of government and the states. Some originalists have argued that as a general rule, constitutional actors should follow original meaning, even if it would conflict with longstanding historical practice or settled precedent.? Other originalists argue that precedent and/or historical practice can trump original meaning in specified circumstances. ?Among originalist judges, Justice Scalia has sometimes argued that precedent trumps original meaning, whereas Justice Thomas seems to be more willing to upset precedent that is inconsistent with originalism.

The New Critics of the New Originalism?

The most recent installment in debates over the new originalism has been the emergence of a recent body of work that criticizes the new originalism.? Love Hurts|| 2 Males needed, 2 Females also needed.

Hey everyone! I've started a roleplay yesterday called "Love Hurts," so I was wondering if anyone could join for a few spots. The roleplays about three teens who were dumped at their school's football game. You see, two of the teens were dating the cheerleader captain and co capain. The last teen was dating the football captain. Their best friends tried to warn them, some more then others. The teens just didn't want to hear it. But now, life for them seems pretty pointless.

So, the teens are dragged into a after school depression program by their best friends.

We have a few spots still open at the moment:

Best friend 1- Was the last to know his best friend was dating the cheerleader and felt hurt. So, he took it out by being a jackass and telling his friend that he should of seen this coming. Best friend 1 didn't care until he found out his friend was cutting.

Best Friend 2- He didn't mean to hurt his friend, but it came out like a insult sadly. He walked in on Emo teen 2 while he was cutting at the park.

Head Cheerleader- She came up with the idea of hurting the teens and fooling them. Only after words did she feel bad for what she did, yet his the fact she did. That is, until she hit her junior year and it was filling the schools the kids were cutting now.

Co Cheerleader Captain- She just went along with it for the hell if it. She truly loved teen 2, but just didn't want to say anything.

Football Captain- He loved head cheerleader, wanting to go along with it for her. He never actually did feel bad until he learned about the cutting.

I'll accept people who aren't the best friends, but I'd love it if someone took one of the roles.
